Terms of service

These terms apply when you use thescribblebot.com.au or buy from us. “We”, “us” and “The Scribble Bot” mean the Australian-owned business that runs this store. By placing an order you agree to these terms, our Refund Policy and our Privacy Policy. Nothing in these terms excludes, restricts or modifies any right you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded.

1. Who can order

You must be 18 or over to place an order. We deliver within Australia only. Orders addressed to freight forwarders or parcel-redirection services may be cancelled and refunded.

2. The product, ages and safety

The Scribble Bot is a drawing toy for ages 3 and up. It is not suitable for children under 3: it contains small parts. Charge it with an adult nearby, never overnight or on a bed, and follow the instructions and safety notes in the box. The markers are water-based and washable; keep them away from children under 3. You are responsible for supervising use in your home.

3. Prices

All prices are in Australian dollars and include GST. Delivery within Australia is free. We may change prices at any time, but a change never affects an order you’ve already placed. If a price is obviously wrong (for example a typing error), we may cancel the order and refund you in full before dispatch, and we’ll tell you why.

4. Orders

Your order is an offer to buy. We accept it when we dispatch your parcel; the order confirmation email is a receipt of the order, not acceptance. We may refuse or cancel an order — with a full refund — if the product is unavailable, if payment can’t be verified, if our fraud screening flags the order, or if the order breaches these terms. If we cancel, we’ll email you.

5. Payment

We accept the payment methods shown at checkout. Payment is taken when you place the order. We don’t store your card details; payments are processed by Shopify Payments and PayPal.

6. Delivery

Every order is sent tracked, and you’ll receive a tracking link by email when it ships. Delivery times shown on the site are estimates based on carrier performance, not guarantees; carriers, weather and public holidays can add days. Please check your delivery address carefully — if a parcel is returned to us because the address you gave was wrong or incomplete, we’ll re-send it once you’ve paid the re-delivery cost, or refund the order less the return cost. Risk in the goods passes to you on delivery. Delivery problems are handled under section 6 of our Refund Policy.

7. Discount codes and promotions

One discount code per order, applied at checkout. Codes can’t be applied after an order is placed, have no cash value, can’t be exchanged for cash and may be withdrawn at any time. Promotions run for the period stated. We may cancel orders that abuse a promotion, for example by creating multiple accounts to reuse a one-per-customer code.

8. Consumer guarantees and the 12-Month Keeps Drawing Promise

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. On top of those rights, every Scribble Bot comes with our 12-Month Keeps Drawing Promise, set out in our Refund Policy. We don’t offer change-of-mind refunds or exchanges at this time.

9. Chargebacks and fraud

If there’s a problem with an order, email us first — we answer every request. Where a chargeback is opened on an order we have delivered, we will provide your bank with the tracking record and our correspondence. We may cancel and refund orders that fail payment verification or fraud screening, and we may decline future orders from customers who have made false claims.

10. Reviews and content you send us

We only publish genuine reviews from real customers, and we disclose it if a reviewer was given anything in return. By sending us a review, photo or video (including by tagging us on social media) you give us a free, worldwide, ongoing licence to use it in our marketing, and you confirm you have the right to give it — including permission from a parent or guardian for any child shown. Email us any time to have your content taken down.

11. Our content and brand

The Scribble Bot name, logo, photographs, videos, words and site design belong to us or our licensors. You may share links to our site freely. You may not copy our product photography, listings or copy for your own commercial use without written permission.

12. The website

We work hard to keep the site accurate and available, but we can’t promise it will be error-free or uninterrupted. If we discover an error in a product description, we’ll correct it and, if it affects an order you’ve placed, we’ll tell you and offer a full refund before dispatch. Third-party links are provided for convenience and we aren’t responsible for their content.

13. Liability

To the extent permitted by law, we aren’t liable for indirect or consequential loss arising from your use of the site or the product, such as loss of time or income. Nothing in this section limits your rights under the ACL, or our liability for anything that cannot be limited by law.

14. Privacy and marketing

We handle your details under our Privacy Policy. If you join the Drawing Club or tick the box at checkout, we’ll email you; every email has an unsubscribe link and it works straight away.

15. Changes to these terms

We may update these terms from time to time. The version on this page when you place your order is the one that applies to it.

16. Governing law

These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction over any dispute.
